Welcome to CommonsInformationBay ("we," "us," or "our"). The following Terms & Conditions ("Terms") apply to your use of our yacht charter services and the website found at commonsinformationbay.sbs (the "Service"), run by CommonsInformationBay.
By reserving a charter or using our Service, you consent to be legally bound by these Terms. Should you not agree with any section of these terms, you must refrain from using the Service.
2. Service Overview
CommonsInformationBay offers luxury yacht charter services, which include but are not limited to:
- Day-long yacht rentals
- Evening cruises
- Company excursions
- Exclusive events
- Extended charters
All offerings are dependent on availability and meteorological conditions. We hold the authority to alter or cease services at our discretion.
3. Booking and Reservations
3.1 Booking Process
Reservation requirements include:
- Minimum age of 18 years
- Provision of valid and comprehensive details
- Payment of the required deposit as outlined in your reservation confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
Your reservation is deemed confirmed only after payment has been made and we have issued a written confirmation. We retain the right to decline service at our own discretion.
3.3 Availability
All charters are contingent upon the availability of vessels and conducive weather conditions. We will exert reasonable effort to accommodate your preferred scheduling.
4. Payment Terms
4.1 Pricing
All quoted pricing is in € and incorporates relevant taxes unless stated otherwise. Prices can change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the entire charter cost, payable upon booking
- Remaining balance: Payable 48 hours before the charter sets sail
- Extra charges (if any): Settled after the charter concludes
4.3 Payment Methods
We accept major credit cards, electronic bank transfers, and certified bank drafts. Payments are processed using secure, encrypted mechanisms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Complete refund minus transaction fees
- Within 24 to 72 hours of departure: 50% refund
- Under 24 hours before departure: Refund not available
5.2 Weather Cancellations
Should the weather be considered unsafe for navigation by our captain, options include:
- Rescheduling your charter to the next viable date without additional expense
- Issuance of a complete refund when rescheduling is unfeasible
5.3 Mechanical Issues
If mechanical malfunctions occur with the assigned vessel, a suitable substitute will be sought. Should no alternative be accessible, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
Passengers must adhere to the following:
- Comply with instructions provided by the crew
- Utilize safety equipment when mandated
- Disclose any health conditions that may impact their safety
- Stay within the designated areas on the vessel
6.2 Prohibited Items
Certain items are not allowed on board:
- Glass containers
- Illegal substances
- Firearms or other weapons
- Pet animals (unless previously authorized)
6.3 Conduct
Behavior from passengers should be kept respectful. Any behavior deemed a safety concern or that disrupts other passengers may result in the charter's termination without a refund.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the cost paid for your charter. We are not liable for:
- Injuries resulting from passengers' own carelessness
- Property loss or damage
- Indirect, subsequent, or penal damages
- Delays from weather or events outside our control
7.2 Insurance Coverage
Appropriate marine insurance is maintained for our fleet and activities. Passengers should arrange their own travel and personal insurance.
7.3 Assumption of Risk
Engaging in our charter services signifies your acknowledgment of inherent risks in maritime activities and your assumption of responsibility for personal safety.
8. Modifications and Itinerary Changes
We reserve the right to adjust itineraries, paths, or schedules owing to weather conditions, safety measures, or operational requirements. We will endeavour to offer similar alternatives.
9. Force Majeure
We cannot be held accountable for interruptions, cancellations, or changes resulting from factors beyond our influence, such as but not limited to:
- Extreme meteorological events
- Natural disasters
- Regulatory enactments
- Port closures
- Technical malfunctions
10. Privacy and Data Protection
Your private data is managed under our Privacy Policy. Utilizing our services expresses your consent to the data collection and usage as laid out in our Privacy Policy.
11. Intellectual Property
All content present on our platform, such as text, visuals, trademarks, and pictures, is safeguarded by copyright and trademark legislation. Reproduction, distribution, or the making of derivative works is not permitted without our explicit authorization.
12. Governing Law
These Terms are subject to the jurisdiction of the laws in Spain. Legal disputes are to be settled in the court systems located in Barcelona, Spain.
13. Changes to Terms
We reserve the prerogative to modify these Terms whenever necessary. Amendments will be shown on our website with an indication of the revision date. Ongoing use of our services indicates agreement to the amended terms.
